By accessing or using this website and/or purchasing a product, you agree to be bound by these Terms of Service. If you do not agree, you must not use our website or purchase from us. We reserve the right to update or amend these Terms at any time, and such changes will apply from the date they are published.

3. Orders and Payments

- All prices are stated in GBP (£) and include VAT where applicable.

- Orders are only confirmed once full payment has been processed through our authorised payment providers (including Klarna, Shopify Payments, and others as listed at checkout).

- We reserve the right to refuse or cancel an order for any reason, including suspected fraud or product unavailability.

4. Shipping and Delivery

- We currently deliver within the United Kingdom only.

- Estimated delivery times are clearly shown at checkout through our delivery partners. These are provided in good faith but are not guaranteed.

- Risk of loss passes to you once products have been delivered to the address provided at checkout.

5. Returns and Refunds

- You have a statutory right under UK consumer law to cancel your order within 14 days of delivery.

- Products must be returned in unused condition and in original packaging, unless faulty.

6. Product Use and Safety

Our products are intended for personal wellness use only.

- Cold water immersion may not be suitable for all individuals. You are responsible for consulting a medical professional before use, especially if you suffer from heart, circulatory, or respiratory conditions.

- Our products are not toys and must not be used by children.

- By purchasing and using our products, you acknowledge and accept full responsibility for safe and appropriate use.

7. Limitation of Liability

- Being Well Cold Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use or misuse of our products.

- To the maximum extent permitted by law, our liability is limited to the purchase price of the product concerned.

- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded by law.

8. Intellectual Property

All content, branding, text, graphics, and images on this website are the intellectual property of Being Well Cold Ltd. You may not reproduce, distribute, or exploit this content without prior written consent.

9. Additional Commitments & Promotional Offers

In addition to your statutory rights, we may from time to time make the following voluntary commitments:

- Charity Donations: We pledge to donate £1 from every sale to Tiny Changes, a Scottish youth mental health charity. This is an independent pledge made by Being Well Cold Ltd. At present we do not have a formal partnership agreement with Tiny Changes, and donations are made by us regularly based on sales.

- Cold Commitment Guarantee: From time to time, we may offer promotional guarantees such as our Cold Commitment Guarantee. These guarantees are voluntary, offered in addition to statutory rights, and full details will be published on our website when active.

- Discounts for Supporters: We may provide discretionary discounts for individuals working in mental health, NHS, blue light services, or related wellbeing roles. These discounts are offered at our discretion, must be applied for directly via email, and may be amended or withdrawn at any time.

These commitments do not affect or replace your statutory consumer rights.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
